Terms of Service

These Terms form a binding contract between you and Earzbook. You accept these Terms by (a) creating an Earzbook account through any supported sign-in method, (b) installing or using the Chrome extension, the web app, or the Android app, or (c) pairing or using the OpenClaw agent integration.

If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 18 years of age, and of the age of majority in your jurisdiction, to create an account and use the Service. The Service is not directed to children.

Age and eligibility are self-reported: the live product does not collect a date of birth, and we do not independently verify your age. By creating an account or using the Service, you represent and warrant that you meet the age requirement above and that the registration information you provide is accurate and current. See the Children’s Privacy section of our Privacy Policy.

The Service comprises several components. Some capabilities are specific to a particular client.

• Chrome extension — capture and transcription. When you start a recording, the extension captures the audio of the current browser tab only. It does not capture your microphone, your screen, or your device’s system or desktop audio. Tab audio is streamed in real time to Earzbook’s own first-party speech-to-text service and transcribed into text; you may select from roughly 99 languages or automatic detection, and you continue to hear the audio at full quality. Raw audio is never stored — it is processed transiently in memory and discarded; only the resulting transcript text, with timestamps, is saved.
• Web app — viewer, account, and billing. The web app at Earzbook.com is a dashboard for reviewing and managing your account. It does not capture or transcribe audio. It provides the OpenClaw AI chat hub, the Insight knowledge views, a Calendar view of your transcripts, a Usage view for credits and billing, and Settings (profile, account deletion) and sign-in.
• Android app. Earzbook also offers an Android app that provides the same features described here on your phone — capture and real-time transcription, the transcript viewer, Knowledge and Insight, OpenClaw, and account and credits. Where the extension captures the audio of a browser tab, the Android app captures the audio you choose to record on your device; raw audio is likewise processed transiently and not stored. These Terms and our Privacy Policy apply to your use of the Android app.
• Knowledge and Insight. From your transcript text we derive interest labels and thematic classifications and present them as a knowledge radar and a progress timeline; you can open a theme to see the specific transcript passages classified under it.
• OpenClaw. An optional integration that lets you pair and chat with an AI agent you install and run on your own computer, and grant that agent account-scoped, read-only access to your own recordings and insights.

Chrome extension permissions. To deliver these features, the Chrome extension requests a limited set of browser permissions, each tied to a specific function: tabCapture (capture the current tab’s audio for transcription); offscreen (host the audio-processing graph and the transcription WebSocket so recording survives service-worker eviction); scripting (inject the transcript and recording interface); identity (Google sign-in through the browser’s web-auth flow, using PKCE); storage (hold your session token, preferences, recording state, a durable transcript retry queue, and a cached credits balance); activeTab (gesture-scoped access to the active tab to acquire the audio stream and inject the interface); alarms (run knowledge processing every five minutes while recording); commands (the Alt+Shift+R shortcut to toggle recording); the toolbar action (start/stop control and the credits badge); externally_connectable (an origin-gated handoff of your sign-in token to Earzbook.com for checkout); and host_permissions (inject the interface and capture audio on the pages you choose to record, and reach our first-party backends and the Whisper transcription endpoint). The extension uses the Google OAuth scopes openid, email, and profile, and does not request notifications, geolocation, cookies, browsing history, bookmarks, downloads, or clipboard access.

We may add, change, suspend, or discontinue features at any time. Software elements that are present but not enabled are not part of the Service and confer no rights.

In the web app and Chrome extension, you create and access your account using Google sign-in (OAuth 2.0, PKCE authorization-code flow) and email one-time passcode (OTP). Other clients, such as the Android app, may offer additional sign-in methods. You are responsible for maintaining the confidentiality of your device, your session, and the email or Google account you use to authenticate, and for all activity that occurs under your account. Notify us promptly at contact@earzbook.com if you believe your account or a paired device has been compromised.

Earzbook enforces a single active recording per account, meaning only one of your devices can actively record at a given time. Signing out clears the session stored on that client; on the extension, signing out also clears the local transcript queue held on your device.

You are solely responsible for ensuring that your use of the recording and transcription features is lawful. Capturing audio — whether from a browser tab, a meeting or call, media playback, or otherwise — may capture the voices, words, and information of other people.

Laws governing the recording of conversations and communications (including wiretap, eavesdropping, and privacy laws) vary by jurisdiction and situation, and some require the consent of one party, all parties, or specific notices. Before recording, you must obtain any consent and give any notices required by applicable law, and by the terms of any platform, meeting, or service whose audio you capture. You must not use the Service to record, transcribe, or process audio in violation of any law, contract, or the rights (including privacy rights) of any person.

Earzbook does not monitor, and is not responsible for, the audio you choose to capture. You agree that you, and not Earzbook, bear full responsibility and liability for the lawfulness of your recordings and for the content you submit to the Service.

You retain ownership of your content. As between you and Earzbook, you own the audio you capture, the transcripts produced from it, your profile information, and any other content you create or submit through the Service (“Your Content”).

You grant Earzbook a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, process, transcribe, encrypt, and display Your Content solely to operate, secure, and provide the Service to you and the features you use — for example, to transcribe captured audio, sync and display your transcripts, generate the AI labels and insights you request, and process your payments. This license exists only to run the Service for you; we do not use Your Content to build advertising profiles, and we do not sell Your Content. The license ends when Your Content is deleted, subject to the retention and deletion rules in our Privacy Policy and to the caveats noted in the “Suspension, Termination, and Account Deletion” section below.

You agree that you will not, and will not attempt to:

• use the Service to record or process audio unlawfully or without any legally required consent of the people recorded;
• submit or process content that is unlawful, defamatory, harassing, abusive, hateful, sexually exploitative of minors, or that infringes another person’s intellectual-property, privacy, or other rights;
• attempt to access, decrypt, or interfere with data belonging to other users, or access any account, device, endpoint, or system without authorization;
• probe, scan, or test the vulnerability of the Service, or breach or circumvent any security, authentication, rate-limiting, or access-control measure;
• reverse engineer, decompile, or disassemble the Service except to the extent this restriction is prohibited by applicable law;
• use automated means to scrape, harvest, or bulk-extract data from the Service;
• abuse, defraud, or manipulate the credits, payment, or metering systems, including chargeback abuse or attempts to obtain recording time without payment;
• interfere with, overburden, or disrupt the Service or the servers and networks that support it; or
• use the Service to build a competing product, or in any manner not expressly permitted by these Terms.

We may investigate and take appropriate action — including removing content, restricting features, and suspending or terminating accounts — for any violation of this Section.

Recording time on the Service is sold as prepaid credits. Credits represent recording time measured in seconds (one credit equals 3,600 seconds, i.e., one hour of recording). New accounts receive a one-time free allowance of 30 minutes (1,800 seconds); this grant is not recurring.

Pricing and currency. Credits are offered in packs through a server-managed catalog. Prices are displayed in your local currency, from a set of supported currencies that we auto-detect from signals such as your device time zone, an offline IP-to-country lookup, and your locale, with a manual override; prices in currencies other than our base currency are converted using live exchange rates. The applicable price is the price shown to you at checkout.

Checkout and payment processor. Payments are processed by Razorpay, our payment processor. Checkout is available only through the web. In the Chrome extension, the “Buy” action opens a focused web checkout window that starts Razorpay’s hosted checkout; you can also purchase credits directly in the web app at Earzbook.com. You enter your card, UPI, bank, or other payment details directly on Razorpay’s hosted surface; Earzbook never receives or stores your card, UPI, or bank credentials. We store only transaction metadata — such as order and payment identifiers, amount, currency, status, the pack purchased, credits granted, a receipt snapshot, and timestamps. Credits are granted only after our payment processor’s signature-verified confirmation of a completed payment; a browser “success” screen alone does not grant credits.

Consumption and metering. Recording time is metered against your credit balance on a wall-clock basis over the life of a recording; we may debit credits for the recording time you use and may require a sufficient balance in order to record. You are responsible for maintaining a sufficient balance for your intended use.

Refunds and expiry. Except where a refund is required by applicable law, or where we choose to issue one, credits are non-refundable, and credits already consumed as recording time are not refundable. Where a refund is issued, the corresponding credits are reversed in proportion to the amount returned (which can reduce your balance, including below zero until you next top up). Purchased credits do not currently expire; if we introduce an expiry in the future, we will disclose it before it takes effect. Your purchase history and receipts are available in the Usage view.

The Service includes AI-assisted features. It processes your transcript text to generate interest labels, thematic classifications, and summaries and to build the Insight knowledge views, and it powers the OpenClaw AI chat. To provide these features, your transcript text is sent to Anthropic (the Claude API) for labeling, classification, and summarization whenever your recordings are processed. Semantic-search insights are powered by numeric embeddings stored in a vector database; the underlying verbatim text is stripped from that vector store and kept encrypted separately.

AI output may be inaccurate, incomplete, or misleading. AI-generated summaries, labels, insights, and answers are produced automatically and may contain errors. They are provided for convenience only and are not professional advice of any kind, including legal, financial, medical, or other expert advice. You are responsible for independently verifying any AI output before relying or acting on it.

OpenClaw is an AI agent that you install, host, and run on your own computer; it is not operated by Earzbook. When you pair it, Earzbook provides a browser-based pairing and authorization step and a real-time relay so your Earzbook account can chat with your own agent, and you can grant that agent account-scoped, read-only access to your own recordings and insights.

Your agent is your responsibility. You are responsible for the agent’s installation, configuration, and security, for the computer on which it runs, and for any third-party AI model or service you choose to have it use. Earzbook does not control your agent’s behavior or output and, to the maximum extent permitted by law, is not liable for your local agent or the models or services it uses. Keep your pairing credentials secure and revoke any paired device you no longer recognize.

OpenClaw chat message content is not stored on Earzbook’s servers — it lives on your own machine and in your browser’s local storage; chat titles are synced in encrypted form. If your agent is temporarily offline, a limited number of your most recent undelivered messages (up to 50) may be held on our servers, in unencrypted form, only until your agent reconnects and receives them, after which they are cleared.

We rely on a limited set of third-party providers to operate the Service; each receives only the data needed for its function. Our full sub-processor disclosures are in the Privacy Policy. We do not use advertising networks, analytics vendors, or data brokers. The active providers are:

Two further services receive no personal data: our foreign-exchange rate source (open.er-api.com) receives only an outbound request for rates, and our currency detection uses a bundled offline IP-to-country database, so your IP address never leaves our servers.

These third parties are governed by their own terms and privacy policies. Sign-in providers such as Google, external links (for example, Earzbook.com, the Google Play listing, and OpenClaw), and any services your self-hosted OpenClaw agent connects to are outside our control. Your use of a third-party service is at your own risk and subject to that third party’s terms.

The Service — including the Chrome extension, the web app, the Android app, our backend, transcription, and insight systems, and all related software, text, graphics, logos, and the “Earzbook” name and branding — is owned by Earzbook or its licensors and is protected by intellectual-property and other laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the extension, the web app, and the Android app for your own use of the Service. You may not copy, modify, distribute, sublicense, or create derivative works of the Service except as expressly permitted by these Terms or applicable law. Third-party names and marks referenced in the Service (such as Google, Chrome, Anthropic, Razorpay, and OpenClaw) belong to their respective owners.

Your use of the Service is also governed by our Privacy Policy, which describes what we collect and how we use, share, secure, retain, and delete your information. Key points relevant to these Terms:

• Raw audio is never stored; only transcript text is retained.
• Transcript text and AI-derived data are encrypted at rest under a per-user AES-256-GCM key that is itself wrapped by Google Cloud KMS. This is encryption at rest and is server-readable by design — we decrypt in memory to serve you and to call our AI provider — and it is not end-to-end encryption. Some legacy data may remain under an earlier encryption scheme until migration completes, so we do not represent that all at-rest data is uniformly encrypted under the current scheme.
• Our servers are hosted on Google Cloud in the asia-southeast1 (Singapore) region; our primary database runs on MongoDB Atlas in an operator-configured region.

Please review the Privacy Policy in full before using the Service.

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that transcriptions, AI outputs, or insights will be accurate or complete; or that recordings, transcripts, or data will always be captured, delivered, synced, or retained. You use the Service — including its recording, transcription, AI, and OpenClaw features — at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the maximum extent permitted by applicable law, in no event will Earzbook or its operators, contributors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service — including any recording you make, any reliance on AI output or insights, any conduct of your self-hosted OpenClaw agent, or any unauthorized access to your data.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the total amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Earzbook and its operators from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your recordings, transcripts, or other content, including any recording made without legally required consent; (c) your configuration, operation, or use of a self-hosted OpenClaw agent; (d) your violation of these Terms or of any law or regulation; or (e) your violation of the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

You may stop using the Service at any time and sign out from any client. You may delete your account from the web app’s Settings (confirmed by an emailed one-time code), or request deletion by emailing us at contact@earzbook.com.

Account deletion and grace period. Account deletion begins a 14-day grace period: if you sign in again within those 14 days, your account is automatically restored. After the grace period, we permanently and cascadingly purge your account data — including your profile, transcripts, live-entry tail, AI summaries and knowledge caches, and shared-content preferences — and we destroy the per-user encryption key held for your account. Destroying that key is a cryptographic erasure that renders data encrypted under it permanently unreadable.

Retention and deletion caveats. Trashed transcripts are soft-deleted and automatically purged 30 days after being trashed; permanently deleting an individual recording removes its transcript and its search vectors immediately. However, some data is intentionally retained after account deletion: knowledge embedding vectors in our vector database, certain derived analytics ledgers, and financial and order records (kept for audit and legal purposes) are not part of the deletion cascade. In addition, a record of your account email is retained indefinitely to prevent re-registration with the same address. Full retention and deletion details, including these caveats, are in our Privacy Policy.

Suspension and termination by us. We may suspend, restrict, or terminate your access to all or part of the Service, with or without notice, if we reasonably believe you have violated these Terms (including the Acceptable Use and Recording sections), if required by law, to protect the Service or other users, or if we discontinue the Service. On termination, your right to use the Service ends. Provisions that by their nature should survive — including licenses already exercised, payment obligations, disclaimers, limitations of liability, indemnification, and governing law — survive.

We may update these Terms from time to time to reflect changes to the Service, our practices, or legal requirements. When we make changes, we will update the “Effective date” above and make the revised Terms available within the Service and/or on Earzbook.com; for material changes, we will take reasonable steps to notify you, such as an in-app notice.

Changes take effect when posted unless we state otherwise. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of India, without regard to conflict-of-laws principles.

The parties will first attempt to resolve any dispute informally by contacting us at contact@earzbook.com. If a dispute cannot be resolved within thirty (30) days, it will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, with the seat and venue of arbitration in India and the proceedings conducted in English. Subject to the arbitration provision, the courts located in India will have exclusive jurisdiction over matters not subject to arbitration. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms or your account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. These Terms, together with our Privacy Policy and any additional terms we present for specific features, constitute the entire agreement between you and Earzbook regarding the Service and supersede any prior agreements on that subject.
